Lowndes Prosecutors Drop Capital Murder Charges

LOWNDES COUNTY, Miss. (WCBI) -- Missing evidence and changed statements from two key witnesses force Lowndes County prosecutors to drop capital murder charges against a Columbus man.

Charlton Colom, 34, was scheduled to stand trial Monday in Lowndes County Circuit Court on charges he forced his way into a trailer at 111 Bill Walker Drive in the New Hope community on Dec. 9, 2008, shot Kevin Gordon and rifled through his pants in search of money.

Two witnesses in the trailer identified Colom several days later, but Assistant District Attorney Mark Jackson says one has now recanted her identification and the other has altered some parts of her story.

"Sometime after this case was indicted one of the eye witnesses, Kendra Montgomery who was present there recanted and said someone else was involved and she pointed at another individual being implicated," Assistant District Attorney Mark Jackson said.

Colom claims he had four witnesses who put him in Ripley, Miss., from the day before the shooting until the day after.

Prosecutors say the pants Gordon was wearing have been misplaced

"The sheriff's department started this investigation and they're going to continue that and see if they can locate any evidence that has been missplaced at this time and continue to look into individuals named here," Jackson said.

Colom, who has a prior cocaine conviction in Lowndes County from 1999, still faces charges in an unrelated case of felon in possession of a weapon. A previous trial in that case ended in a hung jury.
