STARKVILLE, Miss. (WCBI) -- A former Mississippi State student's seven-year effort to clear his name gets new life.

The state Court of Appeals has ordered Oktibbeha Circuit Court to give Bart Ude a jury trial on his appeal of a misdemeanor conviction for stalking by telephone.

It's the second time the appeals court has issued such an order. The first time was four years ago, but Judge Jim Kitchens simply ordered the original 2005 Justice Court six-month suspended sentence imposed.

The Appeals Court says that violated its order and Ude's rights.

No date for Ude's appeal trial has been set.
