WEST POINT, Miss. (WCBI)--The owners of a West Point apartment complex deny they are responsible for the death of Devin Mitchell. Police say the Starkville teenager was visiting family on New's Year Day in the Ridgewood East Apartments when 31 year old Tavaris Collins started firing randomly because he thought someone was shooting at him.

Mitchell's father, Aubrey Mitchell, filed a wrongful death lawsuit in Clay County Circuit Court in June, claiming the owners were aware of his violent nature. The Ridgewood East owners filed their response Thursday, claiming the actions by Collins were unforeseen and actions by those who were responsible for Mitchell's safety, and the actions of the tenant who allowed Collins into their apartment that night, contributed to his death.

The lawsuit seeks a variety of damages, with no specific amount. Ridgewood East owners and their attorney's say imposing damages violates the fifth and 14th Amendments.
