Court Says Lawsuit Can Go Forward

BRUCE, Miss. (WCBI) — A federal appeals court rules a jury should decide whether a Bruce city employee was discriminated against because of his race.

The fifth circuit ruled today that Roderick Gray could take his discrimination case to trial. A federal judge previously had dismissed the lawsuit.

Gray sued the city after aldermen hired a white man to be public works director in 2010, even though Gray had been with the city 20 years and had most of the necessary certifications.

He filed an additional claim last year when the city split the public works department into two divisions again and made Gray head of one of those.

He argues he wasn’t named initially because he is black and that the city split the department in retaliation against his first lawsuit.

The city claims Gray wasn’t hired initially because he wasn’t the most qualified and that his race has had no role in any of its decisions.
