OKTIBBEHA COUNTY, Miss. (WCBI) — The state appeals court says a man will remain in prison for his role in a fatal accident.

The appeals court refused to review the claim from 26-year-old Joshua Buckner who was sentenced to 35 years in prison for aggravated drunk driving.

Buckner pleaded guilty to three charges in connection with the April 2008 accident on the MSU campus that killed Charlesy Collins and injured David Willington and Joanna Morgan.

He later appealed, arguing three convictions from the same crime violated double jeopardy standards.

The appeals court rejected that claim and confirmed that decision this week.

Buckner also is serving 15 more years for identity theft.
