Inmate Loses Effort to Seal Medical Records During Appeal

JACKSON, Miss. (AP) — The Mississippi Supreme Court has denied a motion from death row inmate Bobby Batiste to seal his medical records.

Batiste’s attorneys argued the medical records contain sensitive, personal information about Batiste’s medical condition, mental state and diagnosis. They argue the public disclosure of the records would substantial harm to Batiste’s right to privacy.

In a 7-2 order Thursday, the Supreme Court said Batiste raised the issue of his health in seeking to overturn his death sentence. The court said by going so, Batiste waived any medical privilege to keeping the records secret.

Batiste, now 35, was convicted of capital murder and sentenced to death in 2009 in the death of 28-year-old Andreas Galanis. Authorities say Galanis died after the two got into a fight in 2008 in their Starkville apartment.
