JACKSON, MS (WCBI) – A death row inmate from Oktibbeha County will get the chance to argue for a new trial in his case.

The State Supreme Court today granted Bobby Batiste his post conviction relief request.  That does not mean Batiste gets a new trial for the killing of his roommate in a Starkville apartment but it does give him the chance to appear in Oktibbeha Circuit Court to ask for a new trial.  Batiste, who was convicted and sentenced to die in 2009 says bailiffs improperly counseled and talked with jurors while they were deliberating his case.  No date for when he will get his hearing has been set and he will remain jailed until then.
