Man Granted New Trial in Assault on Lowndes Deputy

LOWNDES COUNTY, Miss. (WCBI) — A 46-year-old Lowndes County man convicted seven years ago of assaulting a sheriff’s deputy is granted a new trial.

The state Court of Appeals ordered the new trial for Steven Yarbrough after ruling his attorney, Rod Ray, had a conflict when he represented him. Ray represented both Yarbrough, and Clint Sims, the deputy Yarbrough was convicted of choking during an arrest in 2006.

Ray did not disclose the possible conflict until the day Yarbrough went to trial and said his friendship with the deputy actually might help Yarbrough’s case. But Yarbrough was convicted by a jury and sentenced to 30 years as a habitual offender, which meant he had to serve the sentence “day-for-day” without credit for good behavior.

No date for a new trial has been set.
