New Trial Ordered In Noxubee Lawsuit

( JACKSON) WCBI – ANoxubee County log truck driver will get the chance to sue the Mississippi Department of Transportation for injuries suffered in a 2009 accident.   Timothy Mixon was driving along highway 21 when he rounded a curve and hit an M-DOT pickup which was partially in the road and then pulled in front of his truck.  A Noxubee County Judge ruled in favor of the state in Mixons lawsuit but today the State court of Appeals ruled sovereign immunity which prevents a public agency from being sued, does not  apply in this case.  The lawsuit now goes back to Noxubee Circuit Court for a trial.
