Video: Co-Op Road Lawsuit Back in Court

LOWNDES COUNTY, Miss. (WCBI)-An 18 month legal battle between Lowndes County and group of residents is going back to court.

In 2011, Lowndes County voted to close Co-Op Road, so, Burlington Northern and Columbus and Greenville railroads could expand a major railroad switching and staging area. Property owners on the east side of the railroad objected, claiming blocking the road violated 140-year-old land agreements that promised three exits across the track. Closing Co-Op Road left them with only one exit and made it difficult for police and fire get to their property. A judge overturned the county’s action and said the county must maintain the road. Today, Columbus attorney and property owner Hal McClanahan asked the board to do just that. Instead, supervisors directed County Attorney Tim Hudson to appeal the judge’s ruling, leaving the crossing blocked for now.
