West Point Mother Avoids Death Penalty in Capital Murder Case

WEST POINT, Miss. – (WCBI) No death penalty. That’s the decision of the district attorney in the case of a Clay County mom accused of killing her child. Britannia Smith,24, is charged with murder in the death of her Brinston Smith, 2 mos.

The infant died back in December after being given a lethal dose of codeine.

The West Point woman was charged with capital murder because prosecutors say giving the child the medicine was child abuse and supported the capital murder charge. That could have led to the death penalty but Assistant D.A. Mark Jackson says they will not pursue that option.

The trial is set to start in January.
