Moore Responds To Sanctions And Expenses Sought

TUPELO ( WCBI) – The lawyer for the family of Ronnie Shumpert says a federal judge should reverse court sanctions against him.  Carlos Moore says in a court filing he should not be penalized for failing to deliver information to the defendants in a timely manner.

Moore says his wife’s illness and a series of death threats in reaction to his state flag suit caused him to miss deadlines.  The Grenada attorney says that falls under a legal standard called excusable neglect.    Fellow attorney Michael Carr of Cleveland is also wading  into the fray.  Carr has filed an affidavit with the court saying attorneys for Tupelo Mayor Jason Shelton, Police Chief Bart Aquirre and Officer Tyler Cook are inflating their legal fees for filing the motions to compel in the case.   We told you yesterday the defendants want Moore to pay$3,086 for their time.  Carr says both motions could have been completed by one attorney in 6 billable hours.
