Supreme Court Rejects Appeal From Calhoun County Man

JACKSON (WCBI) – The Mississippi Supreme Court says it won’t hear an appeal from a Calhoun County man serving a life sentence on a capital murder charge.

Arvin Rochelle says he should be free on parole because of a 2014 change in the way parole is calculated for state inmates.  The state court of appeals rejected that claim in December 2016 saying the new parole guidelines are not applied retroactively.  The Supreme Court Thursday said it will let that December ruling stand.  Rochelle pleaded guilty in 1994 for to arson and capital murder charges in the deaths of Hazel and Nell McMahan. They died when Rochelle set their residence on fire.
