WEST POINT, Miss. (WCBI) — A West Point mother is in jail, charged with killing her two month old son.

24-year-old Brittania Smith is behind bars in the Clay County jail facing a capital murder charge. Investigators arrested Smith after receiving lab results following the death of her son Brinston.

“We were notified by the coroner on Monday, April 7th that a 2 month old infant had died back in December,” said Clay County Sheriff Eddie Scott.

Sheriff Scott isn’t releasing many details but says the abuse from the situation is what lead to this initial charge. Emergency personnel were called to Smith’s home December 20th after the boy was found unresponsive. Paramedics gave him CPR and he was pronounced dead at a local hospital.

“The coroner had actually sent the child for an autopsy at the crime lab. The crime lab basically notified us Monday that the child had died from a lethal overdose of codeine. Which was high amounts of a very lethal amount,” said Sheriff Scott.

WCBI reached out to relatives and friends but they declined an interview.

Codeine is a pain reliever commonly used in medications like Tylenol 3 and cough medicine. Right now, it’s unclear why it was found in little Brinston’s system.

“The child had basically different items in there, but according to the crime lab, the codeine was the main factor in the child’s death. So that’s what has us looking at this as a homicide,” said Sheriff Scott.

The case is being prepared to go to the grand jury. Sheriff Scott says that could be done by Friday.

The grand jury will make the final determination of the charge, meaning it could change.
