Alabama Probate Judges Look to Courts for Gay Marriage Guidance

CLANTON, Ala. (AP) – Alabama judges hope a federal court hearing in Mobile clears up confusion over gay marriage.

At least 22 of the state’s 67 counties are issuing licenses for same-sex marriages, but others are not. Chilton County Probate Judge Bobby Martin says it’s been a difficult week because of conflicting orders from federal courts and Alabama Supreme Court Chief Justice Roy Moore.

Moore told probate judges they didn’t have to issue marriage licenses, despite a federal judge’s ruling overturning the state’s ban on gay marriage. Martin issued a same-sex wedding license Monday, then stopped after learning that about Moore’s order.

Martin and other judges hope a federal court hearing scheduled for Thursday in Mobile provides clarity.
