LOWNDES COUNTY, Miss. (WCBI) — After more than three years in jail on capital murder charges, an Aberdeen man is set free.

Cedric Whitley, 27, was released from the Lowndes County Jail late Friday afternoon after pleading guilty to a misdemeanor charge of receiving stolen property. Lowndes County Circuit Court Judge Lee Coleman sentenced him to six months and a $100 fine plus court costs; he was released on time served since his arrested in late October 2009.

He was fined $100 dollars court costs and released on time served.

Whitley and Sylvester Johnson originally were charged with killing Clarence Trimble during a robbery inside Big C’s Game Room on Highway 373 in October 2009.

Johnson pleaded guilty last August and was sentenced to life without parole.

But Whitley has claimed since his arrest that Johnson shot Trimble when Trimble opened the cash register to get change and that Whitley knew nothing of Johnson’s intentions. Less than $50 was taken.

After spending two hours talking with Whitley today, prosecutors felt Whitley was telling the truth and dropped the murder charges.
