Clay County Capital Murder Trial Set Back

CLAY COUNTY, Miss. (WCBI)– The trial of a Clay County woman charged with capital murder has been delayed.

During this week’s Clay County Circuit Court term, Brittania Smith, of West Point made a motion that she was unable to pay her attorney due to her incarceration. According to court documents Smith had no job, assets or means of paying her attorney.

Smith’s trial has been pushed back to April. If the motion is accepted, Kristen Wood Williams would be appointed by the court to serve as Brittania Smith’s attorney.

Smith was charged in connection with capital murder in connection with the December 2013 death of her two-month old son.  According to the Mississippi Crime Lab, Brinston Smith allegedly died from a lethal dose of codeine, his death was ruled a homicide.
