Inmate Loses Appeal in Classifcation Lawsuit

JACKSON — The state Court of Appeals has denied the appeal of a Lee County man serving time for possession with intent and failure to register as a sex offender.

Chris Cosner pleaded guilty to the charges in February of 2009 and was sentenced to serve eight years in prison.

He argues the Mississippi Department of Corrections classified the drug charge as a violent crime and the failure to register as a sex crime.

Cosner says the designations made him ineligible for parole, meritorius earned time and trusty status.

He says he would not have entered the guilty plea had he known he would not be eligible for a shorter time served.

The Appeals Court denied the appeal request this past week, ruling Cosner should have sought administrative relief with MDOC.
