LOWNDES COUNTY, Miss. (WCBI) — A Lowndes County man who has spent most of the last three years in jail soon will be a free man.

The state Supreme Court Thursday vacated the receiving stolen property conviction of 47-year-old Dexter Calvin Fulton.

In the 10-page ruling, the court said prosecutors did not provide enough detail as to the items he is accused of possessing or trying to sell in either the original indictment or an amended one filed just 10 days before his trial in March 2011.

He originally was charged with trying to sell for scrap some items stolen from Sobley Excavating. After being found guilty by a jury in March 2011, he was sentenced to 10 years as a habitual offender with no eligibility for parole or early release.

Last year, he was granted an appeal bond after the state Court of Appeals upheld his conviction. But the Supreme Court rejected his initial appeal and he returned to jail in July 2013 after a brief bit of freedom

The Supreme Court agreed to look at another aspect of his appeal. That review resulted in Thursday’s ruling, which means he won’t be retired.
