No Re-trial in Fondling Case

COLUMBUS, Miss. (WCBI) – A Columbus man indicted on felony fondling charges will not see a court room anytime soon.

The District Attorney’s Office says, it will not retry the case involving 65 year old Doris McElhenney for allegedly fondling his 11 year old grandaughter with a back massager during a family gathering back in 2009.

McElhenney’s original trial was declared a mistrial after the jury could not reach a verdict.

Assistant Attorney Katie Moulds decided to not retry due to a lack of evidence in the case.
