Video: Clay County Mother Charged in Death of Her Child Denied Bond

CLAY COUNTY, Miss. (WCBI) — A 24-year-old Clay County mother charged with capital murder in the death of her child will remain in jail.

Britannia Smith asked Circuit Court Judge Lee Howard to set a bond for her today so she could get out of jail to get treatment for spinal problems.

But Howard ruled he couldn’t, noting Brittania has a probation revocation pending on a previous forgery conviction.

Her attorney, Jim Waide, says he’ll push for a September trial on the murder charge.

“She has a probation revocation on an old forgery charge, uttering forgery charge, and that’s set for July 16,” Waide said. “Judge Howard will not consider bail until after that’s over. Both sides are trying to get an early trial date set for the murder charge.”

Smith has been in the Clay County jail without bond since her arrest on charges she killed her 2-month-old son with an overdose of codeine cough syrup.

Smith has said she was trying to help the child, and didn’t realize the medicine dose was an overdose.
