Video: Clay County Mother Charged with Capital Murder of Son Seeks Bail

CLAY COUNTY, Miss. (WCBI) — A Clay County mother charged with capital murder in the codeine overdose death of her 2-month-old wants a chance to get out of jail.

A July 2 hearing has been set before Clay County Circuit Court Judge Lee Howard to determine whether 24-year-old Brittania Smith should be granted bail.

She has been held in the Clay County jail without bond since her indictment on charges that she killed her son on an overdose of codeine cough syrup.

Smith’s attorney Jim Waide says Smith suffers from “substantial” back problems the Clay County jail doesn’t have the resources to treat or pay for.
