Mitchell’s parents sued the apartment complex saying they were negligent in allowing their son’s killer Tavaris Collins to live at the complex. The family also claimed the apartment should have reasonably assumed parties involving alcohol would take place on New Years Eve and the risk of something happening past the 10:00 curfew was there but no security was provided. A Clay County judge ruled in favor of the apartment complex which led to the appeal to the Mississippi Supreme Court. The court today once again sided with the apartment complex saying the Mitchell’s had provided no concrete proof the management knew Collins was living at Ridgewood with his girlfriend meaning the apartment complex would have no reason to question Collins’ tendency towards violence.
