Clayton was found dead Sunday afternoon, in a home on Suncrest Street.

Lafayette Circuit Judge Andrew Howorth is considering whether a law requiring probable cause to arrest a police officer applies in Kinne’s case.

The extra step before an arrest is only required when police officers and certain other public employees are accused of crimes while on duty.

Howarth’s order said it was alleged that Kinne was not performing law enforcement duties when he’s accused of killing Clayton.

Howorth said he’ll also consider whether he should set bail for Kinne.

Kinne, who is a member of the Oxford Mounted Patrol, was jailed in neighboring Panola County.
