Attala County Murder Conviction Tossed

JACKSON, MS (WCBI) –  The States highest court has reversed the murder and aggravated assault conviction of an Attala County man.  Markeith Fleming is currently serving a life term for the murder of Christopher Graham as he was driving outside of Kosciusko.  During the trial, Fleming claimed he was in Winona at his girlfriends house.

Prosecutors used testimony from an AT&T engineer to show that Fleming’s cellphone was being used near the murder scene at the time of the murder.  It’s that testimony that led to today’s reversal.  Fleming argued that engineer was only supposed to read from notes but wound up providing what amounted to expert testimony.  The Supreme Court today agreed that the engineer had not been properly verified as an expert and that the defense counsel should have been given a continuance when it discovered the worker was going to provide more details than he was supposed to.  Fleming will now get a new trial for the murder of Graham and the wounding of a passenger in the car Fleming allegedly fired into.
