Video: Moore Files Court Challenge Of Starkville Mayoral Race

STARKVILLE (WCBI) – Starkville mayoral candidate Johnny Moore is going to court seeking a new election.  Moore says numerous irregularities on Election Day and with the handling of absentee ballots is driving the decision to seek a new election.   Attorney William Starks says he knows of at least 60 ballots which should be questioned in an election decided by 6 votes,

Starks says some accepted absentee ballots were improperly marked and others were rejected which  should have been counted.

The Democratic Executive Committee will hold a hearing Tuesday to review the race, but Starks says that is also the deadline for Moore to file a legal challenge so the decision to file the petition to review Monday was made as a precaution.

In an email Monday evening to WCBI, Jim Mozingo, counsel to Lynn Spruill, says in part:

“Nothing in the election contest disturbs us. We have always taken the position that all properly cast ballots should be counted. It is disappointing that the Moore campaign has felt the necessity to try its case in the press and seek to whip up emotion about matters not proven  rather than rely on the process and it’s results. Despite Mr. Moore’s apparent abandonment of his contest before the Committee, we will be there in the morning.
