New Albany Church Must Face Trial In Teenagers Death

JACKSON, MS ( WCBI) – The family of a  New Albany teenager killed on a 2009 mission trip to Costa Rica can sue a New Albany church in connection with his death.  Marshuan Braxton was with a youth group from First United Methodist Church of New Albany when he was hit by a wave while swimming off the coast.  Braxton’s family sued the church for not properly supervising him.  A Chancery Court granted a summary judgement to the church and dismissed the suit.  The Mississippi Court of Appeals Tuesday reversed that decision saying enough evidence existed to indicate Braxton was not properly supervised .  The case will now go back to Union County Chancery Court for trial.
