COLUMBUS, Miss. (WCBI) – A Columbus man convicted of capital murder will get a new trial.

Judge Lee Coleman made the ruling today.

Derrick Bankhead was convicted of killing his cousin on September 1st.

In court documents, Bankhead’s attorney says he learned that District Attorney Scott Colom was Bankhead’s defense lawyer during a preliminary hearing in Columbus Municipal Court on August 18, 2011.

Colom was a stand-in attorney for Bankhead during that hearing.

Colom was later elected district attorney and was the lead counsel during Bankhead’s capital murder trial.

A new trial date has not been set.
