State Supreme Court Will Review Fondling Ruling

OXFORD, Miss. (WCBI) — The state Supreme Court will review a lower court’s decision to throw out a fondling conviction.

Last July, the state Court of Appeals threw out a jury verdict and ruled prosecutors did not prove David Campbell of Oxford was in a position of authority over the victim. The 16-year-old girl was staying with the Campbell family while being treated at the Millcreek Center in Pontotoc.

The authority figure is a key element in a fondling charge when the victim is 16 or older.

The state appealed the appeals court’s decision and the state Supreme Court said today it will review the case.
