Video: Monroe Co. Father Fights Adoption Agency for Custody of Child

ABERDEEN, Miss.(WCBI)–A 3-year-old little girl and what’s in her best interest are at the center of a custody battle between her biological father and a Tupelo adoption agency.

In the company of relatives and his attorney, Markevious Frost could be seen leaving court Friday, continues the fight to gain custody of his little girl born in 2012. That was the year her mother Hannah McCullar relinquished her rights to the baby to New Beginnings Adoption agency without consulting Frost. He says he wants to and should have the right to raise his daughter.

“And I went to the hospital that day my daughter was born and they wouldn’t let me see her,” said Markevious Frost/Birth Father.

Frost has since retained legal council through North Mississippi Rural Legal Services to help get custody. Papers we obtained indicates that a paternity test was performed months after the birth.

“And it did prove conclusively that he was the father of the child. That was actually presented to the court and filed,” said Christinia Townsend/Attorney.

Frost who has not been properly served tells WCBI News he has made it known to New Beginning his opposition to the adoption.

“The court has overlooked the presumption in this state by statute that the mother and father are on equal footing. And he talked a lot about the fact that the mother surrendered her rights, but my client has never surrendered his rights,” said Christinia Townsend/Attorney.

WCBI reached out to New Beginnings for comment, but the agency has not responded to our request for comment.

During a court proceeding Friday, Judge Michael Malski continued the proceeding for 30 days.
